1. Overview
This Privacy Policy explains how MiNood Health Inc., doing business as Superday ("Superday," "we," "us," "our"), collects, uses, discloses, and protects information when you access superday.health or use our Services. We provide our Services nationwide across all 50 U.S. states.
2. Information We Collect
Account & Contact Information: Name, email address, phone number, date of birth, shipping and billing address.
Health Information: Medical history, symptoms, current medications, photographs (if submitted), intake questionnaire responses, and other health information you provide during the intake and consultation process ("Health Information"). This information is collected on behalf of, and reviewed by, the independent licensed clinicians of DrTelx.
Payment Information: Payment card details are collected and processed by our third-party payment processor. Superday does not store full payment card numbers on its own servers.
Usage & Device Information: IP address, browser type, device identifiers, pages viewed, and similar analytics data collected automatically through cookies and similar technologies.
Marketing Attribution Data: If you arrive at Superday through an affiliate or partner link, we may collect referral and click-tracking data through our affiliate tracking platform (Everflow) to attribute your order to the appropriate referral source.
3. Protected Health Information & HIPAA
Health Information you submit is used to facilitate your care by DrTelx's independent licensed clinicians and is handled in accordance with applicable state and federal law, including the Health Insurance Portability and Accountability Act (HIPAA), to the extent applicable. DrTelx, as the Provider Group delivering clinical care, and FOOTHILLS Professional Pharmacy, as the dispensing pharmacy, may each independently maintain obligations regarding your Protected Health Information (PHI) under HIPAA as covered entities or business associates, as applicable to their respective roles. Superday maintains administrative, technical, and physical safeguards designed to protect Health Information transmitted through our platform. In the event of a breach of unsecured Protected Health Information, affected individuals will be notified in accordance with the HIPAA Breach Notification Rule and applicable state law.
4. How We Use Information
We use the information we collect to:
- Facilitate intake, scheduling, and communication with the Provider Group;
- Process and fulfill orders through the Pharmacy;
- Process payments and manage subscriptions;
- Communicate with you regarding your account, orders, and care;
- Send marketing communications, where you have consented (see Section 7);
- Improve and personalize the Services;
- Detect fraud and ensure platform security;
- Comply with legal and regulatory obligations.
5. How We Share Information
We share information with:
- DrTelx and its affiliated licensed clinicians, to facilitate your clinical evaluation and care;
- FOOTHILLS Professional Pharmacy and affiliated pharmacies, to fulfill prescriptions;
- Payment processors, to process transactions;
- Affiliate and marketing platforms (e.g., Everflow), for referral attribution and marketing analytics — this data is generally limited to non-clinical, order-level information and does not include Health Information;
- Service providers who perform functions on our behalf (e.g., hosting, analytics, customer support tools), under confidentiality obligations;
- Legal and regulatory authorities, where required by law, subpoena, or to protect the rights, safety, or property of Superday, our users, or others;
- In connection with a business transaction, such as a merger, acquisition, or sale of assets.
We do not sell your Health Information. We do not share your Health Information with affiliate or advertising partners for their own independent marketing purposes.
6. Cookies & Tracking Technologies
We use cookies, pixels, and similar technologies to operate the Services, remember your preferences, analyze usage, and measure marketing performance, including attribution through our affiliate network. You can control cookies through your browser settings; disabling cookies may affect functionality of the Services.
7. SMS & Email Communications
By providing your phone number and email, you consent to receive transactional messages (e.g., order and appointment updates) and, where you opt in, marketing messages via SMS and email. Message and data rates may apply for SMS. Reply "STOP" to opt out of marketing texts, or use the unsubscribe link in marketing emails. Consent to marketing communications is not a condition of purchase.
8. Data Retention
We retain your information for as long as necessary to provide the Services, comply with legal, regulatory, and recordkeeping obligations (including medical recordkeeping requirements applicable to DrTelx and FOOTHILLS Professional Pharmacy), resolve disputes, and enforce our agreements. Retention periods for Health Information are generally governed by applicable state medical recordkeeping laws, which may require retention for a period of years following your last interaction with the Provider Group.
9. Data Security
We implement administrative, technical, and physical safeguards designed to protect your information from unauthorized access, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Your Privacy Rights & Choices
Depending on your state of residence, you may have rights to access, correct, delete, or restrict certain uses of your personal information, including rights under state privacy laws such as the California Consumer Privacy Act (CCPA), as amended. To exercise these rights, contact us at hello@superday.health. We will verify your identity before fulfilling any request. You may also have the right to request access to or copies of your medical records directly from DrTelx.
11. Children's Privacy
The Services are not directed to, and are not intended for use by, anyone under 18 years of age. We do not knowingly collect personal information from minors. If we learn we have collected information from a minor, we will delete it.
12. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated via email or notice on the Services. The "Last Updated" date above reflects the most recent revision.
